1. Agreement to these terms
By accessing or using Sovelanta or Talverta, you agree to these Terms of Service and our Privacy Policy. If you use a service for a business, you represent that you are authorized to accept these terms for that business.
2. Our services
Sovelanta provides appointment scheduling, client-management, studio-management, reporting, and communication tools. Talverta provides recruiting, interview, candidate-management, scheduling, and communication tools. Features may vary by plan and may change as the services develop.
Our services help businesses organize information and workflows. They do not make hiring decisions, provide legal or employment advice, determine worker classification, provide medical advice, or guarantee appointment, recruiting, financial, or business outcomes.
3. Accounts and authorized use
You must provide accurate information, protect your sign-in methods, and promptly tell us about unauthorized access. Business owners and administrators are responsible for assigning appropriate permissions and for activity performed through their accounts.
You may not misuse the services, attempt unauthorized access, interfere with their operation, upload unlawful or harmful material, use them to violate privacy or communications laws, or send messages without the required permission.
4. SMS messaging terms
SMS consent is optional and is not required to book, schedule, apply, or purchase.
If you provide a mobile number and opt in, you may receive customer-care messages from a business using Sovelanta or Talverta. Messages may include appointment and interview confirmations, reminders, changes, cancellations, rescheduling notices, secure management links, and responses to your requests.
- Message frequency varies based on your activity and the settings of the sending business.
- Message and data rates may apply.
- Reply STOP to unsubscribe from messages sent by that number.
- Reply START to opt back in where supported.
- Reply HELP for assistance.
- Mobile carriers are not responsible for delayed or undelivered messages.
You are responsible for providing a mobile number you control and for updating it when it changes. Businesses using our services are responsible for obtaining consent, honoring communication choices, and sending only lawful messages that match the recipient’s permission.
5. Plans, billing, and payment
Paid plans, add-ons, message allowances, and usage limits are shown when you subscribe. Unless otherwise stated, subscriptions renew automatically until canceled. Taxes may apply. Third-party payment providers process payment details under their own terms.
Carrier and messaging-provider charges may affect SMS availability or allowances. We may limit, pause, or block messaging that appears unlawful, abusive, misleading, or inconsistent with registered campaign requirements.
6. Business and user responsibilities
Businesses are responsible for the information they collect, the decisions they make, their notices to clients and candidates, their appointment and hiring practices, and their compliance with applicable law. Users are responsible for the accuracy and lawfulness of information they enter or send.
Client records, candidate evaluations, scheduling results, calculations, reports, and automated messages should be reviewed by an authorized person when appropriate.
7. Third-party services
The services may connect to payment processors, email and SMS providers, calendar services, video-meeting services, and other third parties. Those services have their own terms and privacy practices. We are not responsible for third-party services outside our control.
8. Ownership and feedback
We and our licensors retain ownership of the services, software, designs, and related materials. You retain ownership of information you submit. You give us the limited rights needed to host, process, transmit, and display that information to provide and protect the services.
If you provide feedback, we may use it to improve our products without owing compensation.
9. Availability and disclaimers
We work to provide reliable services, but availability is not guaranteed. To the extent allowed by law, the services are provided “as is” and “as available” without warranties that they will always be uninterrupted, error-free, or suitable for every purpose.
10. Limitation of liability
To the extent allowed by law, Sovelanta and Talverta will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, opportunities, or goodwill arising from use of the services. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
11. Suspension and termination
You may stop using the services at any time. We may suspend or terminate access when needed to protect the services or others, address nonpayment, comply with law, or respond to a material violation of these terms. Provisions that by their nature should continue will survive termination.
12. Changes and governing law
We may update these terms as our services or legal obligations change. Revised terms will be posted with a new effective date. These terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law principles.
